1) Scope:

These General Terms and Conditions of Sale govern the purchase contract of products and, where applicable, services, entered into remotely by Freddy S.p.A.– henceforth also the “Seller” - and Consumers who wish to purchase a product or service published on www.freddy.com/en-ext. A Consumer is any natural person who purchases goods for purposes that are not related to their professional activity or business, i.e. WITHOUT providing a VAT number (hereinafter referred to as “Consumer” or “Client” or “Customer”). The General Terms and Conditions of Sale shall apply to all transactions completed between the Seller and the Consumer, without having to expressly reference said General Terms and Conditions and without a specific agreement pertaining to them for every single transaction. Terms and conditions other than those stated herein will be applied only after having received written confirmation from the Seller.
The Seller reserves the right, at any time, to change or amend the General Terms and Conditions of Sale, without providing prior notification, including as a result of future changes to applicable laws. The Client shall be bound by said changes only once they are published on www.freddy.com/en-ext. Said changes shall not be retroactive. The General Terms and Conditions of Sale do not govern the sale of products or services from third parties (i.e. other than the Seller) which are found on www.freddy.com/en-ext through links, banners, or other hypertext connections, and Freddy shall not be held responsible for the actions of third parties or for the fulfilment of electronic commerce operations between the users of www.freddy.com/en-ext and third parties. Should one or more of the provisions of these General Terms and Conditions of Sale be deemed invalid, void or for any reason unenforceable, this fact shall not alter the validity and enforceability of the other provisions herein.

2) Identity of the Seller:

Products purchased on www.freddy.com/en-ext are sold directly by Freddy S.p.A., which is registered with the Milan Business Registry, REA number: MI – 1559070, Tax ID 03181770102, VAT No. 00207660994 (nominal capital € 1,000,000.00). The head offices of Freddy S.p.A. are in Italy, at Corso Buenos Aires, 20 - 20124 Milan.

4) Placing an order:

Clients can only order the products found within the online catalogue of www.freddy.com/en-ext at the time the order is placed, viewable online via www.freddy.com/en-ext, and as described in the relative product descriptions. The order form (i.e., the page titled “Checkout”) contains a reference to these General Terms and Conditions of Sale and indicates the product, colour, size and price, as well as the available payment methods and the delivery options and costs. By placing an order, the Client declares to have carefully read and to understand and unconditionally accept all the information provided during the purchase process and to fully accept the General Terms and Conditions of Sale and all the obligations contained therein. Pursuant to applicable laws and regulations, we invite all Consumers to print, save digitally or, in any case, to store these General Terms and Conditions of Sale.

5) Order confirmation and purchase contracts:

All orders will be interpreted as proposed purchase contracts with Freddy for the products ordered, considering each one on its own. The contract shall be considered entered into when Freddy sends a confirmation email to the email address provided by the Client. Said email shall contain all the information relating to the product purchased, its price, delivery fees, the right to withdraw and the legal guarantee. The expected delivery date, on the other hand, will be indicated in a subsequent shipment confirmation email. If the product ordered isn’t available for exceptional reasons, Freddy will notify the Client in a timely manner, specifying what those reasons are. Freddy will then reimburse the price paid for the product (if paid for in advance), pursuant to point 12 below.

6) Products:

The essential qualities of each product can be found on www.freddy.com/en-ext within each product description. Note: The images and colours of the products being sold may not perfectly correspond to the actual look and colour of the products delivered due to the settings and type of internet browser and monitor used.
All Freddy products come with an identifying tag, which is an integral part of the item and which must not be removed if the Client wishes to exercise his/her right to return said item. The Seller reserves the right to deny the return of products that are without their identifying tag. To find your size, click here.
NOTE: The information published on the website www.freddy.com/en-ext is purely for the purpose of disclosure, and can therefore in no way be considered the recommendation of a doctor (i.e., a subject qualified to practice said profession), or in specific cases, of other health workers (dentists, nurses, chemists, physiotherapists, etc.).

7) Changes to the delivery address - order cancellation:

If you have made a mistake when entering your delivery address, please contact our Customer Service Department as soon as possible.

If you want to cancel or change an existing order, please contact our Client Care team. Your order may be cancelled also by simply refusing to accept the package, though to use this option you must also promptly formalise the cancellation by notifying our Client Care team, filling in this form. If your payment has already been processed, Freddy will activate the verification and reimbursement procedure as soon as the package is returned to the warehouse. Please expect the following processing times:

  • approximately 6 business days for the rejected package to arrive to the FREDDY warehouse;
  • approximately 6 business days to verify its contents;
  • Freddy will fulfil all its obligations within fourteen days of the formal notice of refusal. However, for some types of payment cards, the time required to release the amount due depends exclusively on the banking system and may reach their natural expiry date (typically 24-25 days from the date of authorisation).

Once the refund has been processed, Freddy S.p.A. will not be held liable for any direct or indirect damages caused by a delay in the banking system to release the amount involved.

8) Prices:

Product prices, shipping costs and available payment methods are those listed on the website. All amounts are in euros (€). Freddy reserves the right to change the prices listed on the website at any time. However, under no circumstances shall price changes be applied to products already ordered by and shipped to the Client. Under no circumstances shall Freddy be held liable for price variations.
Sales prices include VAT but do not include shipping costs, which will be added to the total amount due. All shipping costs are applied as a flat fee calculated at checkout in the final step of the ordering process, based on the total amount of the order:

  • The shipping fee to Austria, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Latvia, Lichtenstein, Lithuania, Malta, Monaco, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden is €12.00 per order.
  • The shipping fee to Belgium, the Netherlands and Luxembourg is €19.00 per order.
  • Albania, Andorra, Belarus, Bosnia & Herzegovina, Faroe Islands, French Southern Territories, Iceland, Ireland, Moldova, North Macedonia, Papua New Guinea, Réunion, Solomon Islands, South Georgia & South Sandwich Islands, St. Helena, St. Lucia, Timor-Leste, Turks & Caicos Islands, Türkiye, Vatican City: flat shipping fee €25.00 per order.

Shipping is a flat rate calculated at checkout, during the final purchase phase.
Any taxes and/or customs duties shall be covered by the customer. The courier may ask the customer to pay for taxes and/or customs duties when delivering the order.
Note: Shipping fees may vary, or be eliminated (free shipping) during certain promotional periods, which shall be indicated on the website where applicable.

 

9) Payment methods:

www.freddy.com/en-ext accepts the following payment methods:

  • 1) Credit card, prepaid card, Apple Pay, Shop Pay, Google Pay, PayPal (no instalments) or other payment systems made available when placing your order (with the express exclusion of instalment or deferred payment systems such as Paypal 'buy now, pay later' or instalments, Scalapay, Klarna and any others that are made available on the Site, and store credit, which are governed by sub-sections 2, 3 and 4 below) can be used to pay for all orders in a secure manner. Your information will always be processed and transmitted securely via Shopify Payments and will only be disclosed to the bank for the purpose of charging your card. Freddy does not store credit card and prepaid card information. Freddy accepts credit and prepaid cards that belong to the Visa, Mastercard, Maestro and American Express circuits. In addition, Shopify Payments may make other payment methods available: when you place your order, you will be able to view the payment options you can use on the site.
  • 2) Payment by instalments (to date: PayPal 'buy now, pay later' instalments, Scalapay and Klarna in countries where the service is available): in order to pay with financing you must have or create an account on the Scalapay, Klarna or Paypal websites and possess a debit or credit card.
    1. If you pay with Scalapay, you'll receive your order right away and pay in three instalments. You also acknowledge that the instalments will be assigned to Incremento SPV S.r.l., related parties and their assignees, and that you authorize such assignment. When purchasing, you will be immediately charged for the first instalment (equal to one-third of the total). The second instalment will be charged to you one month after the day your order was placed; the third and final instalment will be charged to you two months after the day your order was placed. If you pay within the due dates, you pay only the cost of the items you purchased, with no additional interest.
    2. If you use Klarna, you can pay for your purchases and divide the cost into three equal instalments. At the time of payment, you will see the option 'Pay in 3 instalments without interest.' Simply enter the required information of your payment card to complete your purchase. Klarna does not charge interest, fees or commissions for using the card. However, your bank may charge interest or other fees if, for example, you pay with a credit card which accrues some form of interest.
    3. If you buy with Paypal by logging into your PayPal account, you will see a 'Pay in 3 instalments' option available if you and your purchase are both eligible. If eligible, you can request payment by instalments in a few steps, and you will quickly be able to complete your purchase.

  • 3) Deferred payment : (at present, Klarna in countries where the service is available): Klarna offers the option to defer payment of your purchase if certain conditions and requirements are met.   • 4) Store Credit: store credit is a credit that, until 18/05/2025, was automatically generated as a reimbursement method when ordered products were unavailable, even temporarily. If you have decided to keep your Store Credit you can use it right away to make a new purchase. During checkout, you can decide to use your Store Credit and, if required, select a payment method for the balance due. The amount to be paid will be calculated according to the amount of Store Credit you have. You can check your Store Credit balance whenever you want by logging in to your profile and browsing to the Store Credit section. Please note that Store Credit is a credit that does not have an expiration date. Moreover, you can always request a refund of your Store Credit by bank transfer using this form.

10) FREDDY360° Loyalty Voucher:

To get discounts and benefits, join the FREDDY360° loyalty programme. If you spend €500 on Freddy.com, you will get a FREDDY360° voucher worth €50.00 which can be used on www.freddy.com/en-ext.

Purchases cannot be made using only a voucher. To use a voucher, the total of your order must be at least 15.00 euros over the voucher value, with the balance to be paid via one of the payment methods accepted on the site. In the event that the purchase includes several items, the value of the voucher shall be distributed proportionally among the various products ordered, in the same way which the additional amount paid is distributed.

In case of withdrawal or return (when permitted), the total value of the returned products shall not count toward the €500 expenditure.

In any case, in view of the above-described refund/credit mechanism for withdrawals or returns, the points you earn (to find out how many points you've earned, you can email Freddy Customer Service at info@freddy.com at any time) will be converted into FREDDY360° vouchers only after 40 days from the date of the last order that allowed you to reach the €500 threshold.

The points you’ve accumulated can be converted to vouchers only within the end of the calendar year following that in which you earned them. That means that on 1 January of each year, the points earned before 1 January of the prior year that haven’t been converted to a voucher will expire. For example, on 1 January 2026, all points accumulated up to and including 31 December 2024 that have not generated vouchers will be deleted.

Accumulated vouchers will be valid for 365 days. For example, a voucher issued on 1 June 2025 can be used up to and on 31 May 2026; After that date, it will automatically be deleted by the system

For purchases made on our website with FREDDY360° vouchers, you also have the right to withdraw from/cancel your order as established by law, or to return the items in the order within 40 days. If you withdraw from a purchase or return an order which has been partially paid for with a FREDDY360° voucher, in order to have your Freddy 360 Voucher fully reactivated and the additional amount paid refunded in full, you must return all products which were included in that order. This is because, as stated above, the value of the voucher was proportionally distributed across the various items contained in the order. Of course, you can decide to make only a partial return and, in this case, the value of the returned items will be refunded partly by reactivating your Freddy 360 Voucher and partly by refunding the additional amount paid. PLEASE NOTE: Participation in the FREDDY 360° Loyalty Programme requires the creation and maintenance of your account on www.freddy.com. If you delete your account, no matter the reason, the points and vouchers you’ve accumulated will be automatically deleted and it will be impossible to recover or reactivate them in the future, even if you enrol again.

10 bis) Coupon Codes:

On special occasions, you might also get promotional discount codes (known as Coupon Codes) to be applied to the order total. To find out how the discount codes work and how to use them, click here. If you return a product, the coupon code you used to purchase it cannot be reactivated.

11) Shipping:

The Freddy website indicates the availability of products and their delivery times. However, this information is to be considered purely indicative and not binding for the Seller. Your order will be shipped at the discretion of FREDDY logistics with the best couriers available, to ensure the fastest delivery possible. The Seller shall do everything in its power to comply with the delivery times indicated here which, however, are provided by way of example only. In any case, the Seller shall complete the delivery by and no later than thirty (30) days starting from the day in which the contract takes effect. To learn how to track your order, click here.

12) Product unavailability:

In a Product is unavailable, even temporarily, Freddy will contact the Customer and, on a case-by-case basis, credit the amount paid via the payment method chosen by the customer or reactivate the Freddy 360 Voucher or Store Credit used and/or issue a new coupon code. In case of payment by instalments, any instalment already charged will be refunded directly to the card used to pay for the order, while subsequent instalments will be cancelled and, in case of deferred payments, the amount will not be charged.

13) Product delivery:

To avoid issues with deliveries, the Client must indicate the street number and flat number, where applicable, in the Complete Address field. If you want to receive your order at a business address, remember to select “At my company” when asked “Where do you want to receive the parcel?” during the ordering process, and fill in the “Company Name” field with the name of the company or business where we will deliver the parcel. Delivery is understood to mean street level delivery; if that isn't possible for you, you must let the Customer Service team know.
If the Client receives a package that is not intact, or that is damaged and/or with evident signs of tampering, s/he must notify the courier and sign the transport document adding the wording “with reserve”. This will allow protect the Client against any kind of anomaly found after opening the parcel. All anomalies must be promptly reported to Freddy’s Customer Service. In any case, the contents of the parcel, even if intact, must be checked within twenty-four hours of delivery and, if no complaints are sent to Freddy’s Customer Care department within this period, no later claims will be accepted for faults or inconsistencies with respect to the product or service ordered.
If, on the other hand, the goods delivered have defects or faults, Consumers are guaranteed the rights provided for by the Italian Consumer Code. For further information see point 15 below.

14) Right of return:

Pursuant to art. 52 of the Italian Consumer Code (Leg. Decree n. 206 of 6 September 2005), Customers have the right to withdraw from sales agreements that are entered into online with Freddy without any penalties and without providing a reason, simply by notifying Freddy of their wish to withdraw within 14 (fourteen) days from the date the Customer or a third party designated by the Customer (it cannot be the carrier) has received the item purchased from the official website: www.freddy.com. The right to withdraw is governed by the terms and conditions of Italian law (Leg. Decree 206/ 2005).
In addition, because Customer satisfaction is a priority and in order to facilitate the return process, Freddy will also allow you to directly return the item purchased on www.freddy.com without having to provide a reason for doing so and without having to notify Freddy of your decision in advance, within 40 (forty) days from the order date by following the instructions on the package and also listed below.
It is not possible to request a replacement item. To receive a different product, you will need to complete a new purchase. In addition, you cannot request a return or exercise your right to withdraw for products purchased on websites other than the official one www.freddy.com.Returns and the right to withdraw cannot be applied to products purchased in brick-and-mortar shops.

What can I return?

  • If you purchased multiple products in a single order, you can proceed with a partial return; for example, if you ordered multiple, different products, you can return just one. The partial return option is expressly excluded for all products which are sweatshirt+trousers or t-shirt+trousers sets, such as COMPLETE OUTFITS, TRACKSUITS, WR.UP®-IN TRACKSUITS AND OTHER GARMENT SETS. These products must be returned as a set. We will NOT accept partial returns containing just one of the two pieces that make up the product.
  • All items sold by Freddy S.p.A. come with an identifying tag, which is an integral part of the item. The item being returned must be undamaged and complete, with all its parts (original product bag/packaging, tags, labels and additional accessories). We thus recommend that you try on all items without removing the tag and without damaging the package. In addition, please remember that, pursuant to art. 57 par. 2 of the Italian Consumer Code, you will be responsible for the loss of value of items returned to Freddy S.p.A. due to having used the items in any way except for that necessary to verify their properties, characteristics and functioning.
  • Pursuant to art. 59 of the Italian Consumer Code, the right to withdraw does not apply if the Consumer has purchased custom-made or personalized products, or sealed items that are not suitable for returns for hygienic or health/safety reasons that have been opened after their delivery. For that reason, the following garments are expressly excluded from the right to withdraw and cannot be returned for health/hygiene reasons if the sealed package has been opened: underwear and socks/hosiery.

How do I return a product?

You can return products to Freddy via two different methods. More precisely:
1) In addition to the right to withdraw established by Italian and European law and as specified in point 2, Freddy, in order to facilitate the return procedure, also lets you directly return items within 40 (forty) days from the order date, by following the instructions in the product package, without having to notify Freddy of your decision in advance. Instructions on how to return a product are found in the form included in the package, and can be consulted here.
2) On the other hand, to exercise the right to withdraw from the sales agreement as established by the Italian Consumer Code, in the terms established by law, you must notify us of your decision to withdraw from the sales contract through an unequivocal statement no later than 14 (fourteen) days from the delivery of the product. For that purpose, you can use the withdrawal form found here at the bottom, though it is not obligatory. Any other unequivocal statement expressly stating your decision to withdraw from the contract sent by registered post (to Freddy SpA, Via San Rufino, 31M - 16043 Chiavari (GE) - Italy), fax (to +39 0185 5910300), e-mail (info@freddy.com) or any other suitable means of communication, will also be accepted. The term established for withdrawal shall be considered met if the Customer sends his/her statement of withdrawal no later than 14 (fourteen) days from the date on which the Customer or a third party designated by the Customer (it cannot be the carrier) receives the item purchased in his/her physical possession. If you decide to withdraw, you must return the product(s) after having provided notice of your decision. The products must be returned without delay, no later than 14 (fourteen) days from the date on which you notified us of your decision to withdraw from the contract with Freddy S.p.A. We will use the shipment date of the item to determine compliance with this term: i.e. you must ship the item(s) no later than 14 (fourteen) days from the notification date. Items must be shipped to Freddy S.p.A. c/o Snatt Logistica S.p.a., Via Ruffilli 9, 20042 Pessano con Bornago (MI), Italy.

How can I ship the product(s)?

In both cases mentioned in the previous section, the items must be returned to FREDDY S.P.A C/O SNATT LOGISTICA - Via Ruffilli 9 - 20042 Pessano con Bornago (MI) – Italy with tracked shipping via courier, post or another type of carrier. You must pay the return shipping fees, which will depend on the shipping method you use. We do not accept returns with payment upon delivery. You are entirely responsible for the shipping fees, risk and responsibility until our warehouse has accepted the package.

How should I prepare the package?

  • If still in good condition, you can use the packaging the item was originally shipped in.
  • The product must be undamaged, intact and complete with all of its parts (bag/original packaging, labels, tags, accessories included). Remember that you must also return the identifying tag with the item(s).
  • Include a copy of the return form/statement, indicating the item(s) being returned and your reason for returning it/them in the package.
  • On the outside of the package, apply the shipping label provided by your courier, post office or other carrier, being sure to cover any old bar codes on the package.
  • FREDDY does not accept returns for items which are not in the same condition that they were received in.

Return processing times

As soon as the courier of your choosing has picked up the package, it will generally reach our warehouse in around 5-9 days.
Once the package has reached our warehouse, the processing times are generally:

  • the warehouse staff will verify, within 10 business days, that the items returned comply with the Return policy;
  • if the contents are considered compliant with the Return Policy, the cost of the items will be refunded. For information on refund time lines and methods, without prejudice to compliance with the 14 (fourteen) day term (starting from the moment Freddy was notified of your decision), please see the following paragraph.

Refund times and methods

Pursuant to art. 56 of the Italian Consumer Code, if the products are returned correctly, you will be refunded all payments made to Freddy, including the delivery costs, without undue delay and, in any case, no later than 14 (fourteen) days from the date we were informed of your decision to withdraw from the sales agreement (if there is no prior notification of withdrawal, from the moment we receive the returned items). Please note that you will not be reimbursed for any additional costs resulting from choosing a shipping option other than the standard, least expensive method offered by Freddy. In addition, in the case of partial returns, the flat-rate delivery costs will not be refunded. You must pay the return shipping fees, which will depend on the shipping method you use. We do not accept returns with payment upon delivery.
Compliant with art. 56 par. 3 of the Italian Consumer Code, refunds can be suspended until the item is received, or until the Consumer has demonstrated that the item has been shipped. Only after having received the returned item(s) from the Consumer, or having received proof of their shipment, Freddy will issue a full refund. If it is found that the value of the items has decreased, Freddy will send an email noting the amount subtracted as a reduction of the refund. Freddy will then proceed with the refund of the amount due as quickly as possible. Without prejudice to the duty to comply with the 14 (fourteen)-day period to activate the process for refunding the Customer the sums paid to purchase the goods (the 14-day period commences as soon as Freddy S.p.A. is informed of your decision to withdraw without prejudice to the provisions of art. 56, paragraph three, of the Consumer Code referred to above), the method of refund (and therefore, the time necessary for the amount to be credited) will depend on the method of payment used.
The refund (which is equal to the price paid net of the discount offered by the coupon code used and of any value reduction as referred to above) is processed as follows, it being understood that the coupon code will not be reactivated:

A) SINGLE-SYSTEM ORDER PAYMENT:

  • 1) Credit card, prepaid card, Apple Pay, Shop Pay, Google Pay, PayPal (non-instalment) or with other payment systems that are available when placing the order, expressly excluding Store Credit and instalment or deferred payment systems (Paypal instalment, Scalapay, Klarna and any others made available on the site) which are governed by points 2, 3 and 4 below refunds will be made by Freddy using the same means of payment used when placing the order. Refunds will be issued in 2-5 business days after the warehouse verification of the return is completed. Depending on the payment method and your bank, it may take 3 to 14 business days to see the credit posted to your account. NOTE: The time required to redeem the payment with some types of credit cards depends solely on the bank, and may in some cases be made on the natural expiry (usually 24-25 days from the date of authorization).
  • 2) Store Credit the credit will be issued in a measure equal to the value of the articles returned
  • 3) Payment by instalments (to date, Paypal instalment, Scalapay and Klarna only in countries where available): if you have chosen to pay by instalments, the amounts related to the instalments already paid will be automatically reimbursed directly to the card you used to pay for the order, while the instalments not yet paid will be cancelled. You will have to wait 3 to 14 business days before the refunded amount is posted to your account. For partial refunds, the refund amount will first be deducted from the unpaid instalments, which will be reduced or cancelled, and, if necessary, you will then be refunded entirely or in part for the already-paid instalments.
  • 4) Deferred Payments (to date, Klarna in countries where the service is available): if you have chosen the 'pay later' (deferred payment) option and the payment deadline has not yet passed, you will not be charged for the items returned. Otherwise, the amount you have already paid will be refunded directly to the card you used to pay for the order. You will have to wait 3 to 14 business days before the refunded amount is posted to your account. In the case of a partial return, however, you will only be charged for the amount equivalent to the items you have chosen to keep, and if you have already been charged for said items, we will issue a refund in the same manner as above.

B) PAYMENT VIA MULTIPLE METHODS:

Anytime when payment has been made using a Store Credit, a coupon/discount code or a Freddy 360 voucher together with one of the payment methods referred to in paragraph A) above, please note that the value of the Store Credit (as well as that of the coupon code or the Freddy360° voucher that may have been applied at check-out) will be proportionally distributed among the various items contained in the order.
For this reason, for partial returns, the refund of the price of the returned item(s) will be made by applying the same proportionality and, therefore, the amount due will be refunded, on a case-by-case basis, by partial reactivation of Freddy 360 Credit and/or Store Credit and, for the remaining balance, using the same payment method you used for the purchase. However, coupon codes cannot be reactivated once they have been used.
In the event that the balance due had been paid by means of Scalapay, Klarna or Paypal (payment by instalments), depending on the value of the returned item(s) (pro-rated as described above), the instalment already charged will be refunded, in whole or in part, directly to the card used to pay for the order, while subsequent instalments will be recalculated by Scalapay, Klarna or Paypal and, where applicable, cancelled.
If a deferred payment method has been chosen for the balance due and the payment due date has not yet passed, you will not be charged for the amount of the refund owed. Otherwise, the amount you have already paid will be refunded directly to the card you used to pay for the order.

15) Legal Guarantee:

Freddy S.p.A. guarantees the Consumer, pursuant to and by effect of European Directives 1999/44/EC and 2019/771, and Italian Legislative Decree n. 206/2005 (Consumer Code), that all goods shall conform to the descriptions published on the website and are free from any defects existing at the time of delivery, for a period of 2 (two) years from the date the goods are delivered to the Consumer. In accordance with Article 133, Paragraph 3 of the Consumer Code, direct actions to enforce non-conformities and defects not concealed by the seller with fraud shall lapse, in any case, after 26 (twenty-six) months from the delivery of the goods.
The application of any and all commercial guarantees is excluded in cases of use, repair, washing, drying, ironing or manipulation/handling of the goods that do not comply with those of the goods itself and/or the relative instructions/warnings provided by Freddy S.p.A., that is, those listed in the illustrative documents of reference, tags or labels.
Pursuant to art. 135 of the Consumer Code, all defects that appear within one year from delivery of the goods are assumed to have already existed on that date (unless this hypothesis is incompatible with the nature of the goods or with the nature of the defect). Therefore, exclusively in these cases, the Consumer is excluded from the burden of proof of proper use of the goods. In any case, Freddy S.p.A. retains the right to provide evidence to the contrary.
The Consumer must report any defects and/or non-conformities sending an email to Freddy S.p.A. at info@freddy.com, including a request containing the following information:

  • Description of the defect and/or the faulty elements found
  • The following documentation: at least 1 photograph of the product, the order confirmation sent by Freddy S.p.A. and/or the tax receipt
  • Order number
  • Order date
  • Name
  • Surname
  • Email address
  • Product code
  • Product name
  • Size
  • Quantity

Nevertheless, all other statements that unequivocally indicate that the defect has been reported remain valid. Once the statement and the relative documentation requested as a preliminary procedural matter have been received, Freddy S.p.A. will assess whether the defects and/or non-conformities reported by the Consumer via Freddy's Customer Service are ostensibly covered by the conformity guarantee or not, notifying the Consumer of its decision through the email address indicated in the statement sent via email, authorising or denying the return of the goods. A copy of the return authorisation must be included in the return package.
If Freddy S.p.A. denies the request, the reasons will be listed in the response email.
Authorisation to return the item(s) shall not, in any way, constitute a recognition of defect or non-conformity. The latter will be assessed only once the goods has been returned to the warehouse.
Goods that have been approved for return by Freddy S.p.A. must be sent by the Consumer via the courier indicated in the return authorisation with the shipping costs to be paid for by Freddy S.p.A., or via a different means to be paid for by the Consumer, which must in any case allow traceability of the shipment.
The package must contain the item(s) being returned, with the original packaging where possible, a copy of the return authorisation, and a copy of the email sent to inform of the defect and/or irregularity.
The Consumer must ship the goods within 14 (fourteen) days after reporting the defect and/or non-conformity and, in any case, only after having received the authorisation of Freddy S.p.A.
If no defect is found, the item will be returned within about 30 (thirty) days from the date of return delivery, with the shipping expenses to be paid by the Consumer.
If a defect is found, Freddy S.p.A. will propose one of the following solutions to the Consumer within 10 (ten) days from having received the goods (or, in any case, within a reasonable period, even if longer, in the case of complex investigations):
1. repair, free of charge;
2. replacement, free of charge;
3. a price reduction;
4. a full refund of the price paid, keeping the item at the warehouse.
In accordance with Article 135b of the Consumer Code, the Consumer can choose between Freddy S.p.A. repairing or replacing the goods, without additional costs applied to either option, unless the request is objectively impossible or excessively burdensome compared to the other option pursuant to the criteria established in the aforementioned article 135b paragraph 2. The Consumer also retains the right to request a proportional price reduction, or to terminate the sales contract should one of the conditions of article 135b, paragraph 4, sections a), b) and c) of the Consumer Code apply. In any case, it is not possible to request termination of the contract for minor defects.
Should the Consumer choose the replacement of the goods or the partial reimbursement of the price paid, the shipment of the goods to the Consumer will be paid for and handed by Freddy S.p.A. in a subsequent reasonable amount of time (circa ten days).
Should the Consumer choose to repair the goods, subject to the intervention of the service department, Freddy S.p.A. will inform the Consumer of the outcome of the repair within the following 20 (twenty) days (or, in any case, within a reasonable period, even if longer, in the case of complex repairs and/or interventions). The return shipping to the Consumer, paid for by Freddy S.p.A., will occur within a reasonable period (circa ten days).
Should Freddy S.p.A. be required to refund, either totally or in part, the Consumer the amount paid, the refund shall be issued within approximately 14 (fourteen) days from the refund notification or the submission of the bank details, whichever is later. If necessary for the purposes specified below, the Consumer shall provide his/her bank details to Freddy S.p.A., at the e-mail address info@freddy.com, so that the wire transfer can be made.

Only Consumers (any natural person who purchases goods for purposes that are not related to their professional activity or business, i.e. WITHOUT providing a VAT number) who are at least 18 years old are allowed to make purchases from and use the services offered on Freddy.com.

20) Applicable laws and dispute resolution:

These General Terms and Conditions of Sale are governed by Italian law, in particular by Legislative Decree no. 206 of 6 September 2005 (the Italian Consumer Code) and subsequent amendments with particular reference to the regulations on digital contracts and by Italian Legislative Decree no. 70 of 9 April 2003 and subsequent amendments on certain aspects of e-commerce. This is without prejudice to the application of more favourable mandatory rules for the protection of Consumers, if provided for by the law of the country of residence of the Client. In the event of a dispute, the Italian court shall have jurisdiction over the matter; for all disputes relating to the validity, interpretation or execution of these General Terms and Conditions of Sale, territorial jurisdiction shall lie with the court of the place of residence or domicile of the Client, if located in Italy.
