1. THE FREDDY MEMBERSHIP PROGRAMME

The Freddy Membership Programme (henceforth the “Programme”) is governed by the following terms and conditions and is coordinated and managed by Freddy SpA, with registered offices in 20 Corso Buenos Aires, Milan, Italy (VAT 00207660994), certified email [email protected].

Enrolling in the Programme entails acceptance of the following terms and conditions, which the interested party is asked to read carefully before joining the Programme. For any questions or requests for clarification, Freddy can be contacted via its Customer Service department, from Monday to Friday, 9 am to 1 pm and 1:30 pm to 5:30 pm, by calling +39 0185 59101, sending a WhatsApp message to +39 349 5579993, or emailing [email protected].

Purchases made on www.freddy.com are governed by the general terms of sale which are available directly on the website.

The Programme is a loyalty programme offered by Freddy at its own discretion. The Programme lets members take advantage of many exclusive benefits and promotions, as fully described in the paragraphs below. The relative benefits and promotions are intended to be exclusively personal in nature and for purposes unrelated to business and/or professional activities. Said benefits and promotions cannot be transferred to third parties.

 


2. HOW TO ENROL

To enrol in the Programme, you must be a natural person who is at least 18 years old and you must have an email account

Registration is free and does not require a purchase. You can register online via the following web page: Freddy Membership

It is also possible to register at our points of sale in Italy, San Marino and Switzerland (as listed here), using the online procedure and without having purchased anything.

The relative form must be fully completed with accurate, true, up-to-date information.

Upon enrolment, you will be provided the relative policy on the processing of personal data and you will be asked to provide your consent, pursuant to applicable laws.

ATTENTION: participation in the Programme is based upon the creation and retention of an account on www.freddy.com. Therefore, if the member’s account is cancelled, for any reason, said member cannot continue to take advantage of the Programme’s benefits.

 


3. BENEFITS

Enrolling in the Programme makes it possible to obtain the following benefits:

  1. Special discounts and promotions
  2. Early access to promotions
  3. Birthday bonus
  4. Access to special content.

 

Member benefits cannot be combined with other discounts or promotions which are being offered on the same products. However, members can use the personal discount codes assigned to them, such as the welcome discount code or the birthday discount code.

 

3 A SPECIAL DISCOUNTS AND PROMOTIONS

Members can take advantage of special promotions which include discounts or other advantages for the purchase of Freddy products on www.freddy.com

 

3 B EARLY ACCESS TO PROMOTIONS

Members will be advised via the newsletter or SMS (according to the system which Freddy determines to be most opportune on a case-by-case basis) of their early access to promotions destined for all users.

 

3 C BIRTHDAY BONUS

Coinciding with their birthday, members will be sent a code which gives them 20% off a shopping cart with a minimum value of €59.00 (calculated as the product total excluding any shipping costs or other additional expenses) which can be used for the following 30 days. This one-time discount can be used just once in the aforementioned 30 days: the code will be deactivated automatically once used and it cannot be used again.

 

3 D ACCESS TO SPECIAL CONTENT

Only Programme members will have access to special content, such as fitness/yoga video lessons.

Moreover, members will be notified before other users about events that are open to everyone, and thus will have priority during registration.

The aforementioned special content may be expanded or reduced at Freddy’s sole discretion. Freddy will inform members of all news and updates via newsletter.

 

3 E RETURNS WITHIN 40 DAYS

Members will always have the right to return purchased products, provided said return takes place within 40 days from the order date, i.e., irrespective of the general terms and conditions of sale as published on the website.

 

 

4. ACCOUNT CREATION AND USE

Upon enrolment in the Programme, the user will be asked to provide their information and create their login data (email and password), necessary to access the user dashboard.

Programme members are responsible for suitably saving and storing their login information, which they alone will be fully responsible for, not sharing said login information with others or making it accessible to third parties.

In the event of suspected theft and/or illegal or unauthorised use of such information, the Programme member must immediately inform Freddy and change their password according to the instructions provided by the Customer Service team.

The proper functioning of the member account requires suitable technological devices and may require future software updates, which the member shall promptly instal.

Moreover, the member shall be the only party responsible for using and monitoring the devices and email account used.

Enrolment in the Programme requires familiarity with the means of communication used, such as telephone and/or internet networks, and the acceptance of the risk of outages and more generally the risks which are inherent to online communication, such as limited data protection, malware and viruses. Members are responsible for taking all suitable and reasonable measures to protect their computer or mobile device and the relative content.

Freddy shall not be liable for any problems or malfunctions related to hardware, software, telephone lines, data lines, or the internet connections used by the member, which could inhibit the member from participating in the Programme or taking advantage of the relative benefits.

Programme members expressly agree:

  • not to use their account and their enrolment in the Programme in general for business or Commercial purposes;
  • not to carry out actions or conduct which could damage, compromise or in any way interfere with the functioning of the Programme;
  • not to use their enrolment for illegal and/or unauthorised purposes, including the spreading or distribution of computer viruses, or the spreading or distribution of content which is discriminatory, offensive, abusive, defamatory or detrimental to the rights of Freddy or third parties;
  • not to assign or transfer to third parties the benefits and services reserved for members of the Programme, for any reason whatsoever.

 

 

5. MEMBERSHIP WITHDRAWAL. PROGRAMME TERMINATION. AMENDMENTS

Members may withdraw their membership at any time and of their own free will, simply by logging into their account, selecting “Privacy Settings” and following the relative instructions.

At any time, Freddy may make changes to the terms and conditions herein (for example, but not limited to, the benefits and related methods of purchase) without, however, impacting rights already acquired by the member as of the date which those amendments came into force. Said amendments will be published on www.freddy.com and will be valid from their date of publication: members will be notified via email at the email address entered upon registration. Where deemed necessary, members may choose to withdraw from the Programme.

Freddy reserves the right to suspend or revoke the Programme, providing notification in the form required by law. Suspension or withdrawal of the Programme does not entitle members to any sort of compensation or indemnity.

Freddy reserves the right to block and, if necessary, also cancel an account if it is found to be in breach of these conditions or otherwise suspects unlawful use of the account.

Moreover, Freddy reserves the right to revoke discounts or benefits given to the member thanks to enrolment in the Programme, where it deems that they have been obtained in an unauthorised and/or erroneous and/or fraudulent manner.

As noted above, account cancellation, for any reason, will imply the impossibility of using the expected benefits.

 

 

6. APPLICABLE LAWS AND DISPUTE RESOLUTION:

These Conditions are governed by Italian law, in particular by Legislative Decree no. 206 of 6 September 2005 (the Italian Consumer Code) and subsequent amendments with particular reference to the regulations on digital contracts and by Italian Legislative Decree no. 70 of 9 April 2003 and subsequent amendments on certain aspects of e-commerce. This is without prejudice to the application of more favourable mandatory rules for the protection of Consumers, if provided for by the law of the country of residence of the member.

In the event of a dispute, the Italian court shall have jurisdiction over the matter; for all disputes relating to the validity, interpretation or execution of these General Terms and Conditions of Sale, territorial jurisdiction shall lie with the court of the place of residence or domicile of the member, if located in Italy. This is without prejudice to the application of more favourable mandatory rules for the protection of Consumers, if provided for by the law of the country of residence of the member

8. MISCELLANEOUS

Should any of the provisions contained in these Terms and Conditions be deemed by the competent authorities to be invalid, void or unenforceable for any reason whatsoever, said provision shall be deemed severable and shall not have any bearing on the validity and enforceability of the other provisions.
