Freddy S.p.A. guarantees the Consumer, pursuant to and by effect of European Directive 1999/44/EC and Italian Legislative Decree n. 206/2005 (Consumer Law), that all products are free of design and material defects and comply with the description published on the website, for a period of 2 years from the date the products are delivered to the Consumer.
All guarantees are voided if the item is used or washed in a way that is incompatible or unsuitable to that which is intended and/or the instructions/warnings provided by the Seller and/or the Owner, that is, the information found in the provided illustrative reference documents, tags or labels.
Please note that, pursuant to art. 132 of the Italian Consumer Code, defects that appear within 6 months from the delivery of the item are presumed to have existed prior to delivery. The Consumer thus is not required to prove the correct use of the item.
Under penalty of voiding of this guarantee, the Consumer must report any defects and non-compliant elements by and no later than 2 months from their discovery, sending an email to the Seller ([email protected]) including his/her request and the following information:
• Description of the defect and/or the faulty elements found
• The following documents: at least 1 (one) photograph of the item, the order confirmation sent by the Seller and/or the tax receipt/invoice
• Receipt/invoice number
• Receipt/invoice date
• Email address
• Product code
• Product name
All other statements that unequivocally indicate that the defect has been reported remain valid.
Once the statement has been received along with the aforementioned documents, Freddy S.p.A. will assess whether or not the defects and non-conforming elements reported by the consumer through the Owner’s assistance service are covered by the product guarantee, responding to the Consumer via the email address provided on the form and approving or denying the request to return the item(s). A copy of the return authorisation must be included in the return package.
The Seller will provide a motive for rejected return requests via email.
Authorisation to return the item(s) shall not, in any way, constitute a recognition of defect or non-conformity. The latter will be assessed only once the item has been returned to the warehouse.
The items that Freddy S.p.A. authorises for return must be shipped by the Consumer either via contracted courier at the Seller’s expense, or via other means at the Consumer’s expense.
The package must contain the item(s) being returned, with the original packaging where possible, a copy of the return authorisation, and a copy of the email sent to inform of the defect and/or irregularity.
The Consumer must ship the item within 14 days from reporting the defect/non-conforming element.
If no defect is found, the item will be returned within 30 days from the date of return delivery, with the shipping expenses to be paid by the Consumer.
If a defect is found, Freddy S.p.A. will propose within 10 days from the date of return delivery one of the following solutions:
1. Free repair;
2. Free replacement;
3. A price reduction;
4. A full refund of the price paid, keeping the item at the warehouse.
Should the Consumer chose to have the item replaced or receive a partial refund of the price paid, the item will be shipped back to the Consumer at the expense of the Seller within 10 days.
If the Consumer chooses to have the item repaired, subject to assistance intervention, Freddy S.p.A. will notify the Consumer once the item is repaired, within 20 days. Shipments back to the Consumer, paid for by the Seller, will be sent within 10 days.
If Freddy S.p.A. is to refund the Consumer for the full purchase price, it will be done through the same payment method used by the Consumer when purchasing the item, or via bank transfer no later than 14 days from the notification of refund or transmission of the Customer’s banking information.
It will therefore be the Consumer’s responsibility to notify the Seller of his/her IBAN and other banking details by emailing them to [email protected].
